Below is a template letter you can send to plaintiff's counsel when sharing an Offer Package. It frames the package as the settlement-side counterpart to a demand package, explains the benefits of exchanging a detailed evaluation early, and invites counsel to flag factual inaccuracies or missing context, while making clear the package is an advocacy document sent under the applicable rules governing offers and compromises.

Attached is an Offer Package regarding this matter.

Similar to demand packages, an Offer Package articulates the basis for the offer amount. The Offer Package reflects our current evaluation based on the information available to us at this time. As expected in an advocacy-oriented settlement communication, it emphasizes the issues, defenses, and case considerations we believe are important to our evaluation of the claim.  It is sent pursuant the state rules of evidence regarding offers and compromises.

We believe sharing this information early in the process provides several benefits:

  1. Transparency. Settlement positions are often exchanged with limited explanation. By providing our analysis and supporting considerations, we hope to facilitate a more informed and productive dialogue regarding the strengths, weaknesses, and value of the case.
  2. Earlier Case Evaluation. Providing a more detailed evaluation earlier in the life of the claim allows the parties to assess their respective positions sooner, identify areas of agreement or dispute more efficiently, and engage in more meaningful resolution discussions.
  3. More Efficient Communication. We hope this package helps focus discussions on the key factual, legal, medical, and damages-related issues that are most likely to influence resolution.

Internally, the package is intended to facilitate a more rigorous evaluation of the information currently available before the claim professional determines the appropriate offer amount.  

Externally, we are giving you more explanation than carriers historically provide.  If you believe the package contains factual inaccuracies or omits material context relevant to our evaluation, we welcome that input and will consider it as part of our continuing assessment of the claim.
